1. Acceptance of these terms
These Terms of Service (“Terms”) apply to your use of this website and to quotes, orders and services provided by Asheville Engine Inc. (“Asheville Engine,” “we,” “us”), located at 385 Warm Springs Rd, Alexander, NC 28701. By requesting a quote, placing an order or using the website, you agree to these Terms. If a written quote or invoice contains terms that differ from these Terms, the quote or invoice controls for that transaction.
2. Products and services covered
These Terms cover remanufactured engines, diesel engine rebuilding, long blocks, short blocks, rebuild kits, replacement components and related diesel parts and services offered by Asheville Engine Inc. This website provides general information only. It is not an offer for sale and does not publish prices, part numbers, inventory or technical specifications.
3. Quotes and estimates
Quotes and estimates are prepared from the information you provide. They are not binding until confirmed in writing and accepted by both parties. Pricing, scope, availability and terms may change if the information supplied is incomplete or inaccurate, or if inspection reveals conditions that differ from what was reported. Changes to scope will be communicated to you before additional work or charges proceed.
4. Engine compatibility information supplied by customers
Engine and application details, including engine family, model year, vehicle or equipment and engine identification, are supplied by the customer. Asheville Engine Inc. relies on that information when recommending and quoting products and services. You are responsible for the accuracy of the information you provide and for confirming that the products you order suit your application. We are not responsible for incompatibility resulting from incorrect or incomplete information.
5. Remanufactured engines, long blocks and short blocks
The contents of each remanufactured engine, long block or short block are described in the quote or invoice. Items not listed are not included. Product descriptions on this website are general and do not specify components, ratings or specifications.
6. Diesel engine rebuilding services
Rebuilding services are performed according to the scope of work agreed in writing. Additional work found necessary during the project will be discussed with you before it proceeds. Timing is provided for each project and is an estimate unless confirmed otherwise in writing.
7. Rebuild kits and replacement components
Rebuild kits, replacement components and related diesel parts are supplied as described in the quote or invoice. Kit and component contents depend on the engine and application and are confirmed before you order.
8. Core or exchange requirements
Where applicable, an order may require you to return a usable core or exchange unit. Any core or exchange requirement, its condition criteria and any related charges are stated in the quote or invoice. Failure to return a required core in the condition and within the period stated may result in additional charges.
9. Invoice-based payments
Payments are invoice-based. Amounts due, accepted payment methods and payment timing are stated on your invoice. Please do not send payment card numbers through website forms or unsecured email. Late or unpaid balances may delay further work or shipment.
10. Deposits and advance payments
Where applicable, a deposit or advance payment may be required before work begins or an order is placed. The amount, purpose and any conditions for a deposit or advance payment are stated in the quote or invoice. Deposits and advance payments apply toward your total and may be non-refundable to the extent they cover work performed or items ordered or specially prepared for you, as described in your quote or invoice.
11. Order changes and cancellations
Requests to change or cancel an order must be sent to us in writing. Changes and cancellations may be limited or unavailable once parts have been ordered or prepared, or work has started, and you remain responsible for work performed and items ordered or prepared up to the time of the request. Any change in price or timing will be communicated before it takes effect.
12. Shipping and freight
Where shipping applies, shipping and freight charges, carrier and delivery arrangements are stated in the quote or invoice. Delivery estimates are not guaranteed. Risk of loss passes according to the shipping terms in your quote or invoice. Inspect packages on delivery and note any visible damage with the carrier and with us as soon as possible.
13. Inspection and acceptance
You should inspect products promptly on receipt, or on completion of services, and notify us in writing of any apparent damage, shortage or discrepancy as soon as possible and within the period stated on your invoice or quote. Products and services not reported as non-conforming within that period are considered accepted, except as otherwise provided by law or by a written warranty.
14. Returns
Where returns are available, the conditions are stated in the quote or invoice. Returns require our prior written approval. Engines, assemblies and components that have been installed, or that are special-ordered, custom-built or prepared for your application may not be eligible for return. Returned items must be in the condition required by the return approval, and return shipping and any related charges are described in that approval.
15. Warranties
Asheville Engine Inc. provides a warranty only where one is expressly stated in writing for a specific product or service. Any warranty has its own terms, coverage and limitations, which are provided in writing. Descriptions, statements and illustrations on this website are not warranties. Except for a warranty expressly provided in writing, and to the fullest extent permitted by law, products and services are provided without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.
16. Installation responsibilities
Unless installation is expressly included in your quote or invoice, you are responsible for the installation of products, whether performed by you or a third party. Installation, break-in, operation, maintenance and the condition of related systems and components are the responsibility of the customer or installer. Follow applicable manufacturer procedures and good industry practice. Failure to do so, or issues arising from improper installation, operation or related system conditions, may affect warranty eligibility where a warranty applies.
17. Limitation of liability
To the fullest extent permitted by law, Asheville Engine Inc. is not liable for indirect, incidental, special, consequential or punitive damages, including loss of use, downtime, towing, rental, lost revenue or lost profits, arising from products, services or use of this website. To the fullest extent permitted by law, our total liability for any claim relating to a product or service is limited to the amount you paid to us for that specific product or service. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
18. Website use and trademarks
You may use this website for lawful purposes related to learning about and contacting Asheville Engine Inc. Content on this website, including the Asheville Engine name and logo, belongs to Asheville Engine Inc. and may not be copied or used without permission. Ford, Powerstroke, GM, Duramax, Cummins and International are trademarks of their respective owners. They are used only to identify the engine families we work on. Asheville Engine Inc. is an independent company, not affiliated with, authorized by or endorsed by those manufacturers.
19. Governing law
These Terms and any dispute relating to them or to our products and services are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any legal action will be brought in the state or federal courts located in the State of North Carolina, and you consent to their jurisdiction.
20. Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top shows when they were most recently revised. Terms in effect when you place an order, or those stated in your written quote or invoice, apply to that order.
